1. Order Acceptance & Confirmation

1.1 Your order is considered a “request to purchase” our drinkware (Thermos Flask, Plastic Cup, Glass Cup) and does not constitute a binding contract until we issue a formal order confirmation email. This email will include your order number, item details, total cost, and shipping address—please review it immediately and contact us if there are errors.1.2 We reserve the right to reject or cancel orders for the following reasons, with prompt notification to you:
  • Stock Shortages: If an item is out of stock after you place an order, we will notify you within 2 business days and issue a full refund to your original payment method (no deductions or fees).
  • Pricing Errors: If a product is listed at an incorrect price due to website glitches, typographical mistakes, or system malfunctions, we will cancel the order and explain the error. We will not honor incorrect prices unless explicitly confirmed in writing by our team.
  • Incomplete/Incorrect Address: If your shipping address is missing critical details (e.g., house number, apartment unit, postcode) or is invalid, we will contact you via email/phone to verify. If we do not receive a response within 5 business days, we may cancel the order to avoid delivery delays or lost items.
  • Suspected Fraud: We may cancel orders if we detect fraudulent activity (e.g., invalid payment cards, multiple orders with the same address using different payment methods, or orders shipping to high-risk locations). We will provide limited details to protect against fraud and may require additional verification (e.g., proof of address) before processing future orders.

2. Payment Terms

2.1 Accepted Payment Methods: We accept the following secure payment options for UK orders:

  • PayPal
  • Apple Pay
  • Klarna (buy now, pay later): Available for orders over £30 GBP, allowing split payments into 3 interest-free installments. Klarna’s approval is subject to their credit check, and their terms and conditions apply (see Klarna’s website for details).

    2.2 Payment Security: All payments are processed through PCI DSS-compliant gateways. We never store full credit card numbers, CVV codes, or bank account details—your financial data is encrypted and protected by industry-leading security measures.

    2.3 Deposits for Custom Items: For personalized drinkware (e.g., engraved Thermos Flasks, custom-printed Plastic Cups), a 30% non-refundable deposit is required at order placement to cover material and production costs. The remaining 70% is due before shipping (we will notify you via email when payment is required). If you cancel a custom order after production has started, the deposit will not be refunded—we may, at our discretion, offer a partial refund if production is in early stages.

    2.4 Payment Processing: Credit card/PayPal/Apple Pay payments are processed immediately upon order placement. Klarna payments are authorized at checkout, with installments charged according to Klarna’s schedule. Failed payments (e.g., insufficient funds, expired cards) will result in order suspension—we will notify you to update payment details within 3 business days; otherwise, the order will be canceled.

3. Product Descriptions & Variations

3.1 We strive to provide accurate, detailed descriptions of all drinkware (including sizes, materials, insulation performance, and safety features) on our website. However, minor variations may occur due to:
  • Batch Production: Colors, finishes, or printed designs (e.g., kids’ Plastic Cup patterns) may vary slightly between production batches.
  • Insulation Performance: Thermos Flask heat/cold retention times are based on laboratory conditions (e.g., 24 hours for hot drinks, 16 hours for cold drinks). Actual performance may vary by ±1 hour due to external factors (e.g., extreme temperatures, frequency of lid opening).
  • Size Tolerances: Cup/Thermos capacities may have a ±5% variance (e.g., a “500ml Thermos” may hold 495–505ml) due to manufacturing standards—this does not affect functionality.

    3.2 We do not consider minor variations as “misrepresentation” under the UK Consumer Rights Act 2015. However, if a product differs significantly from its description (e.g., a “microwave-safe Glass Cup” that cracks in the microwave, a “leakproof Thermos” that leaks), you may return it under our Return & Exchange Policy (see Section 5).

4. Shipping & Delivery

4.1 Shipping terms are governed by our separate Shipping Policy, which includes details on destinations, costs, timelines, and tracking. By placing an order, you agree to the terms of this policy.4.2 We are not liable for delivery delays caused by third-party carriers (e.g., Royal Mail, DPD) due to circumstances beyond our control (e.g., weather, strikes, customs delays for remote areas). We will, however, assist you in tracking and resolving issues by filing claims with the carrier.4.3 Risk of damage or loss of items passes to you upon delivery (or upon confirmation of delivery by the carrier). If you suspect a delivery is missing or damaged, you must notify us within 24 hours of the carrier’s “delivered” status (see Section 6 for claims).

5. Returns & Exchanges

5.1 Returns and exchanges are governed by our separate Return & Exchange Policy, which outlines eligibility criteria, request procedures, and timelines. By placing an order, you agree to these terms.5.2 We reserve the right to reject returns that do not meet eligibility requirements (e.g., used items, items without original packaging, final sale products). If a returned item is rejected, we will notify you and arrange for it to be returned to you at your cost.

6. Liability & Indemnity

6.1 Limitation of Liability: Our liability for any claim arising from your order (e.g., defective products, delivery errors) is limited to the purchase price of the affected item(s). We are not responsible for indirect, incidental, or consequential damages, including but not limited to:
  • Injury or property damage from improper use (e.g., Glass Cup broken due to rough handling, Thermos lid popped off from carbonated drinks).
  • Loss of use (e.g., a delayed Thermos missing a camping trip) or loss of data (e.g., order details lost due to technical issues).
  • Costs incurred from third-party services (e.g., replacement items purchased elsewhere due to a delay).

    6.2 This limitation does not apply to liability for death or personal injury caused by our negligence, fraud, or breach of statutory duties (as required by UK law).

    6.3 Indemnity: You agree to indemnify and hold us harmless from any claims, damages, or costs (including legal fees) arising from:
  • Your improper use of our products (e.g., using a non-microwave-safe cup in a microwave).
  • Your failure to provide accurate information (e.g., incorrect shipping address leading to lost items).
  • Your violation of these Terms & Conditions or applicable UK laws.

7. Intellectual Property

7.1 All content on our website (including product images, descriptions, logos, and brand names) is our intellectual property or licensed to us. You may not copy, reproduce, distribute, or modify this content without our prior written permission.7.2 Product designs (e.g., Thermos Flask insulation technology, Glass Cup shape) may be protected by patents or trademarks—unauthorized replication is prohibited.

10. Governing Law & Dispute Resolution

10.1 These Terms & Conditions are governed by English law.
